If the Jersey Birds post by Harvey Tomlinson is accurate then Mr. Tomlinson, the unidentified couple and the photographer, Mr. Freiday, were trespassing in an area (the wooden staircase) that is clearly designated for “Authorized Personnel Only”. In addition the rock climber in the photograph is also in violation of the rules of Merrill Creek Reservoir that clearly state the the main dam is off limits to the public. A poor example was set by all concerned. Birder's or photographer's should not be encouraged to disrespect the rules of private property owners and/or put themselves or others in danger.
@TOMV, you jumped to conclusions. I was on the trail at MCR several hundred yards from the owl. Observed the young man in the photo from great distance (640mm worth of lens, out of reach of voice). The real point of the photo was that the young man climbing the dam did not see the owl at all. Happily, the owl did not flush.
